Warranty Exceptions:
Exception – On Site Labor:
Hourly Labor and Labor at a client physical location (site) comes with a limited lifetime warranty to be free of defects and last for years.
Exception Equipment Installed On Site:
Equipment installed On Site is Warrantied for 1 year from the date of purchase. If the manufacturer has a longer, such as, lifetime or limited-lifetime upRiver Support will transfer title of the warranty to client.
upRiver Support Agents maintain all equipment. We will pick up / return and install equipment and systems. We ask that our client’s pay hourly labor to an authorized upRiver Support Agent that installs new or replaces faulting / failing equipment.
Exception – Battery Backups and Surge Protection:
Client locations are always offered the ability to have surge protection and battery backups in case of weather related and electrical wiring related to power spikes, surges etc and or a combination. Many of the products we offer for sale online and install on a client site are low voltage DC systems. These systems when connected to a computer network need strict regulation of power to operate properly.
We offer Power Surge and Backup Power Protection Systems to all clients yet some will decline this support. In those cases we can only honor the manufactures warranty and cannot guaranty your equipment and the lifespan of the hardware will be shortened. Weather and Dirty Power is a number 1 and 2 reason for most equipment failure. Especially in dealing with low voltage systems.
NOTE: Warranty on Labor / Equipment is void unless a proper power surge and backup system is installed.
If the power system is malfunctioning and a work around is put in place or a temporary patch is employed, all warranty of the Labor / Equipment is void (except with manufactures warranty)

LIMITED LIFETIME HARDWARE WARRANTY
UPRIVER.STUDIO / SPEEDSTREAM.TV warrants to the original owner that the product delivered in this package will be free from defects in material and workmanship. This warranty does not cover the product if it is damaged in the process of being installed or improperly used.
THE ABOVE WARRANTY IS IN LIEU OF ANY OTHER WARRANTY, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF NONINFRINGEMENT OF UPRIVER.STUDIO / SPEEDSTREAM.TV INTELLECTUAL PROPERTY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE ARISING OUT OF ANY PROPOSAL, SPECIFICATION, OR SAMPLE.
This warranty does not cover replacement of products damaged by abuse, accident, misuse, neglect, alteration, repair, disaster, improper installation, or improper testing. If the product is found to be defective, UPRIVER.STUDIO / SPEEDSTREAM.TV , at its option, will replace or repair the hardware product at no charge except as set forth below, or refund client purchase price provided that client deliver the product along with a Return Material Authorization (RMA) number (see below), along with proof of purchase (if not registered), either to the dealer from whom client purchased it or to UPRIVER.STUDIO / SPEEDSTREAM.TV with an explanation of any deficiency. If client ship the kit(s) product, client must assume the risk of damage or loss in transit. Client must use the original container (or the equivalent) and pay the shipping charge.
UPRIVER.STUDIO / SPEEDSTREAM.TV may replace or repair the product with either new or reconditioned parts, and any kit(s) product, or part thereof replaced by UPRIVER.STUDIO / SPEEDSTREAM.TV becomes UPRIVER.STUDIO / SPEEDSTREAM.TV ’s property. Repaired or replaced products will be returned to client at the same revision level as received or higher, at UPRIVER.STUDIO / SPEEDSTREAM.TV ’s option. UPRIVER.STUDIO / SPEEDSTREAM.TV reserves the right to replace discontinued products with an equivalent current generation kit(s) product.
RETURNING A DEFECTIVE PRODUCT
From North America:
Before returning any kit(s) product, contact SUPPORT@UPRIVER.STUDIO / SPEEDSTREAM.TV Customer Support and obtain a Return Material Authorization (RMA) number by calling +1-512-200-4788
If the Customer Support Group verifies that the product is defective, they will have the RMA department issue client an RMA number to place on the outer package of the kit(s) product. UPRIVER.STUDIO / SPEEDSTREAM.TV cannot accept any product without an RMA number on the package.
All other locations:
After calling 1-512-200-4788 and getting RMA issued, return the product for a refund or replacement. Client assumes responsibility for shipping and sufficient insurance to: ATTENTION: UPRIVER.STUDIO / SPEEDSTREAM.TV , 1300A Texas Avenue, Bryan Texas 77803. Credits typically take 8-10 weeks.
LIMITATION OF LIABILITY AND REMEDIES
UPRIVER.STUDIO / SPEEDSTREAM.TV ’S SOLE LIABILITY HEREUNDER SHALL BE LIMITED TO DIRECT, OBJECTIVELY MEASURABLE DAMAGES. IN NO EVENT SHALL UPRIVER.STUDIO / SPEEDSTREAM.TV HAVE ANY LIABILITY FOR ANY INDIRECT OR SPECULATIVE DAMAGES (INCLUDING, WITHOUT LIMITING THE FOREGOING, CONSEQUENTIAL, INCIDENTAL, AND SPECIAL DAMAGES) INCLUDING, BUT NOT LIMITED TO, INFRINGEMENT OF UPRIVER.STUDIO / SPEEDSTREAM.TV INTELLECTUAL PROPERTY, REPROCUREMENT COSTS, LOSS OF USE, BUSINESS INTERRUPTIONS, LOSS OF GOODWILL, AND LOSS OF PROFITS, WHETHER ANY SUCH DAMAGES ARISE OUT OF CONTRACT NEGLIGENCE, TORT, OR UNDER ANY WARRANTY, IRRESPECTIVE OF WHETHER UPRIVER.STUDIO / SPEEDSTREAM.TV HAS ADVANCE NOTICE OF THE POSSIBILITY OF ANY SUCH DAMAGES. NOTWITHSTANDING THE FOREGOING, UPRIVER.STUDIO / SPEEDSTREAM.TV ’S TOTAL LIABILITY FOR ALL CLAIMS UNDER THIS AGREEMENT SHALL NOT EXCEED THE PRICE PAID FOR THE PRODUCT. THESE LIMITATIONS ON POTENTIAL LIABILITIES WERE AN ESSENTIAL ELEMENT IN SETTING THE PRODUCT PRICE. UPRIVER.STUDIO / SPEEDSTREAM.TV NEITHER ASSUMES NOR AUTHORIZES ANYONE TO ASSUME FOR IT ANY OTHER LIABILITIES.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to client.
SLA Service Level Agreements & Critical Control Applications: UPRIVER.STUDIO / SPEEDSTREAM.TV specifically disclaims liability for use of the product in critical control applications (including, for example only, safety or health care control systems, nuclear energy control systems, or air or ground traffic control systems) by Licensee or Sublicenses, and such use is entirely at the user’s risk. Licensee agrees to defend, indemnify, and hold UPRIVER.STUDIO / SPEEDSTREAM.TV harmless from and against any and all claims arising out of use of the product in such applications by Licensee or Sublicenses.
Software: Software provided with the product is not covered under the hardware warranty described above. See the applicable software license agreement which shipped with the product for details on any software warranty.
